Two years of correctional supervision for stealing groceries worth R1 600

The following cases were heard in the Boksburg Magistrates Court:

* Mozambican citizen Jose Joao Mugambi (26) and his co-accused, Ndlovu Zwelithini (30), were both found guilty of driving a car without the owner’s consent.

Both men pleaded guilty to the charge on July 24, and were sentenced on the same day.

They had no previous convictions and the court sentenced them to a fine of R9 000 or six months in prison.

Magistrate Sijren Harichand presided and prosecutor Nokosazana Tyeku represented the state.

* Vusimuzi Ntombeni, of Phase Two in Vosloorus, was convicted of housebreaking with intent to steal, and theft.

He pleaded guilty on May 20 and the district court also found him guilty as charged.

However, his case was transferred to the Regional Court for sentencing on July 28, due to his numerous previous convictions.

Ntombeni broke into Amos Makgoza’s house in Vosloorus on March 22, and stole an amplifier, speakers, bedding, sneakers, jewellery and a cellphone, among other things.

He was sentenced to 12 years imprisonment, four of which were suspended for five years.

He was also declared unfit to possesses a firearm.

Magistrate Sijren Harichand presided and Nkosazana Tyeku represented the state.

* Solomzi Luzuko Mabuza (29) was convicted on 16 charges of fraud.

During the period from January 16, 2014 to November 2014, the accused unlawfully, falsely and with intent to defraud and to the prejudice or potential prejudice of Michelle’s Travel Agency give out and pretended that 16 amounts, ranging between R650 and R1 4252.65 and totalling R141 703.53, were due to be paid to several guest house service providers for services rendered.

However, the accused knew that the amounts were not due to be paid to the service providers and he did not pay the amounts to any service provider, but deposited them to his girlfriend’s bank account.

He was an employee at the travel agency.

He had no previous convictions and was sentenced to 36 months correctional supervision and house arrest.

He was further sentenced to 16 hours of community work per month for the duration of the sentence. He may not use alcohol or drugs during that period and neither is he allowed to travel outside the Boksburg magisterial district without permission.

He should also not commit any offence for the next 36 months.

Magistrate Molefe Ratlau presided and prosecutor Palesa Setshedi represented the state.

* Laurens Mtyephi (41), of Somalia Park, pleaded guilty and was found guilty on July 28, of attempted copper theft.

He attempted to steal copper from the Ekurhuleni Metro on May 19.

He has no previous convictions and was sentenced to 18 months in prison.

Magistrate Jurg Viviers presided and Themba Maluleke represented the state.

* Thabiso Bapela (29), of Katlehong, pleaded guilty to two charges of theft on July 14.

The court also found him guilty as charged and sentenced him on July 27.

On June 1, Bapela stole, among other things, groceries from Pick n Pay in the Chris Hani Mall worth R1 600.

He has four previous convictions and he was sentenced to 24 months of correctional supervision, was placed under house arrest, will serve 16 hours of community service per month for the duration of the sentence, and is not allowed to leave the Boksburg magisterial district without permission. He was also placed under high risk monitoring.

Magistrate Jurg Viviers presided and prosecutor Themba Malileke represented the state.
