Life in prison for raping a minor

The following cases were heard in the Boksburg Magistrates Court:

* John Mputla (30), of Delmore Gardens, will spend life in prison for raping a minor in 2011.

The accused repeatedly raped a 15-year-old in Delmore Gardens, on December 7.

He pleaded not guilty on May 18, but the court found him guilty on August 29.

He was sentenced to life imprisonment.

Magistrate Abel Shilubane presided and prosecutor Maria Olivier represented the state.

* Philani Eric Ngobese (28), of Witfield, was convicted of murder and the theft of a motor vehicle, on August 31.

On 14 March, in Riling Street, the accused fatally stabbed Raheem Periasamy multiple times in the upper body, with a knife.

The victim sustained stab wounds in the chest, neck, arms and his back.

On the same day, the accused stole a Honda Ballade belonging to Navlice Motilala.

He was found guilty and sentenced to 12 years in prison for murder and seven years for theft of a motor vehicle.

The sentences will run concurrently.

Magistrate Colbert Ramofhufhi presided and prosecutor Takalane Mokhubo represented the state.

* Tshepo Molefe (34), of Vosloorus, was convicted of theft on August 29.

The accused intentionally and unlawfully stole four blocks of cheese valued at R319.80 from Boxer.

He has six previous convictions for theft, between 2009 and 2015.He was sentenced to three years in prison.

Magistrate Hans Havenga presided and prosecutor Themba Maluleke represented the state.

*Musa Makhosi (25), of Phumula informal >settlement, and *Sbusiso Mthimkhulu (28), of Deavi informal settlement, were both convicted of theft on August 29.

The two accused pleaded guilty and were both found guilty on July 28.

On June 20, in Holly Street, Dawn Park, the two broke into Phillipus Jakobus’s property and stole a laptop and three bottles of Klipdrift brandy.

Makhosi had previous convictions of reckless and negligent driving in 2 of009, four cases theft, in 2010, 2012 and 2013, housebreaking and theft in 2011, and possession of drugs in 2012.

Mthimkhulu has a housebreaking and theft conviction.

The two men were convicted in the District Court, but because the magistrates in this court felt the maximum sentence the law allows them to impose is not severe enough for the crimes, they transferred the case to the Regional Court for a stiffer sentence.

In the Regional Court, >Makhosi was sentenced to 12 years in prison and >Mthimkhulu to 10 years in prison.

They were also ruled unfit to possess firearms.

In the District Court, magistrate Jurg Viviers presided and prosecutor Themba Maluleke represented the state.

In the Regional Court, magistrate Sijren Harichand presided and prosecutor Nkosazana Tyeku represented the state.

* Onias >Mcube (31) of Ivory Park, Givemore Dude (32) of Berea, Thulani Mhlanga (25) of Tembisa, and Dumisani Ndlovu (29) of Berea were convicted of business robbery with aggravating circumstances on August 31.

On July 14, 2013, the men, all Zimbabwean nationals except for Mhlanga, stole tiles, two cellphones and two compressors, all valued at R861 735.77, from Tiles 2000.

The four accused, who were armed with a firearm at the time of the offence, pleaded not guilty on February 14, but were all found guilty as charged.

Accused one, two and three were sentenced to 12 years in prison, while accused four was sentenced to 20 years in prison.

Magistrate Colbert Ramofhufhi presided and prosecutor Takalane Mokhubo represented the state.

* Mpho Masenamela (30), of Tembisa, was convicted of theft on August 29.

The court found that, on September 15, the accused acted in common purpose with co-perpetrators when they stole a >cellphone and cigarettes from hawker Gilbert Mdluli at gunpoint.

Masenamela was the only suspect arrested and the court sentenced him to 15 years in prison.

Magistrate Abel Shilubane presided and prosecutor Maria Olivier represented the state.

* Shaun Pieterse, age and address unknown, was convicted of reckless and negligent driving on August 15.

The accused drove into a stationary minibus with his Toyota >Hi-lux, on Rondebult Road, in 2013.

He was sentenced to five months in prison or a fine of R5 000, suspended for four years.

Magistrate Ryan van Haarte presided and prosecutor Palesa Setshedi represented the state.
