Eighteen year sentence for stabbing victim 15 times

The following cases were heard in the Boksburg Magistrates Court:

* Moses Shabalala (26), of Mohlabeng Village, was convicted of murder on March 26 and sentenced on August 20.

This is after he stabbed Sandisiwe Xalsa to death in 2012.

She sustained 15 stab wounds and 14 punctures to her body.

The accused has no previous convictions and was sentenced to 18 years in prison.

The court ordered that he serve two third of his sentence before being considered for parole.

Magistrate Abel Shilubana presided and prosecutor Maria Olivier represented the state.

* Themba Oscar Buthelezi (28), of Jabavu, Soweto, was convicted on July 14.

Buthelezi pleaded not guilty to attempted robbery with aggravating circumstances (count one), possession of an illegal firearm (count two) and possession of illegal ammunition (count three).

But the court found him guilty as charged.

The accused attacked Maria Kutumela and Mbali Mkwanazi in January, last year, and with force, and at gunpoint, attempted to take their cellphones.

He has eight previous convictions dating back to 1997; five for housebreaking, one for robbery, one for escaping from custody and one for theft.

On August 21, he was sentenced to 12 years on count one, 15 years on count two and 10 years on count three.

The court ordered that half of the sentenced on count one and the full sentence on count three run concurrently with the full sentence on two, meaning he has been sentenced to an effective 21 years in prison.

He has also been ruled unfit to possess a firearm and the court ordered that he be stripped of any firearm licences.

Magistrate Sijren Harichand presided and prosecutor Leon Naude represented the state.

* Hasazi Sibindi (30), of the Angelo informal settlement, was sentenced to prison for theft and rape.

In November 2014, Sibindi sexually assaulted his victim and robbed her of her handbag, containing two cellphones and other items.

He pleaded not guilty on June 8, but the court found him guilty of rape (count one) and theft (count two), on August 13.

He has no previous convictions.

He was sentenced to 10 years for rape and three years for theft and the court ordered that the sentences run consecutively.

Magistrate Abel Shilubana presided and prosecutor Maria Olivier represented the state.

* Costa Daringo Inquare (22), a Mozambican national living in the Marathon informal settlement, was convicted on August 24.

Inquare was found in possession of an imitation 1.765mm calibre revolver.

He had no previous convictions and the court sentenced him to 18 months in prison.

Magistrate Emmanuel Magampa presided and prosecutor Angeline Mooiman represented the state.

* Themba Nkosi (20), of Elston Avenue, Benoni, was convicted of theft on August 20.

The accused stole two pairs of sandals worth R459.90 from Shoe City.

He was also prosecuted for stealing 10 slabs of chocolates worth R209.90 from Pick ‘n Pay, East Rand Mall.

He has six previous convictions for theft and was sentenced to 18 months in prison.

Magistrate Molefe Ratlau presided and prosecutor India Roos represented the state.

* Jan Lesiba Ndlovu (29), of Vosloorus, pleaded not guilty to bumping into another vehicle while driving a state police truck.

The court found that, in November 2014, Ndlovu unlawfully and intentionally drove into the rear of the car in front of him, after he failed to keep a safe following distance, which led to him failing to stop in time.

He was sentenced to a fine of R6 000 or 12 months in prison.

Magisatrate Emmanuel Magampa presided and prosecutor Angeline Mooiman represented the state.

q Malangabe Bonolo, of Katlehong, pleaded not guilty to a charge of negligent driving, on July 14.

Bonolo was driving his Nissan bakkie when he caused an accident involving a motorbike, on January 3, 2014.

Though the driver of the bike could not remember what happened on the day of the accident, the court relied on the accident scene evidence to prosecute Bonolo.

He was sentenced to a fine of R10 000, or 24 months in prison, half of which was suspended for five years.

Magistrate Emmanuel Magampa presided and prosecutor Angeline Mooiman represented the state.

q Halalisani Madela (18), of Windmill Park, was sentenced to prison after violating the conditions attached to his earlier correctional supervision sentence.

Madela was sentenced to correctional supervision for 24 months on April 23.

The conditions restricted him to his home, but, on numerous occasions, correction supervision officers could not find him at home when they went to do inspections.

The officer reported to the court that Madela was not adhering to the condition of his sentence.

He was subsequently arrested and sent to prison for 18 months on August 24.

Magistrate Jurg Viviers presided and prosecutor Themba Maluleka represented the state.
