Confusion over who will investigate CPF shooting

The Boksburg SAPS and Elsburg SAPS are in total disagreement over who should investigate the fatal CPF shooting of a burglary suspect, in Freeway Park, last month.

The shooting followed a CPF chase that ensued after patrollers noticed a gang of alleged burglars exiting a property in Elspark.

Although the Boksburg SAPS has, on numerous occasions, told the Advertiser that the matter would be investigated by the Elspark SAPS, a spokesperson for the Elsburg SAPS, Const Daphne Phooko, repeatedly stated that her station has no jurisdiction over cases that happen outside its precinct.

“The shooting happened outside of our precinct; the shooting will be investigated by the Boksburg police,” said Phooko.

A spokesperson for the Boksburg SAPS, Lieut Kwendzakwakhe Ngobese, admitted that an enquiry docket registered at the Boksburg Police Station, on Tuesday, March 31, is still at the Boksburg Crime Office, adding that they are still trying to get the Elsburg SAPS to collect it.

Asked if any criminal charge will be brought against the CPF member who pulled the trigger, Ngobese said it is hard to say anything definite about what will happen without knowing the facts around the suspect’s death.

Boksburg SAPS station commander, Biggs Govender, previously told this publication that although murder is suspected, the inquest into the death of the alleged burglar will determine whether the gunman fired in self-defence or not.

According to the police, after an investigation is complete, the findings will be delivered to court, which will decide if the CPF member acted within the confines of the law.

If not, the court will then have to determine with which crime the member should be charged, and if there’s enough evidence to bring a criminal charge.

The debacle followed a high-speed car chase between the Freeway Park/Elspark CPF members and the gang of suspected burglars, which ended with one of the suspected men being shot dead outside Freeway Park Primary School.

He was allegedly shot by one of the CPF members.

The CPF members managed to apprehend one of the deceased’s accomplices and recovered some of the goods apparently stolen from the house in Elspark.

The suspect is facing charges of housebreaking and possession of suspected stolen goods.
