This is according to National Prosecuting Authority spokesman, Nathi Ncube.
He added that the NPA felt that it could not continue with the prosecution of Zanokuhle Mbatha in Senzo Meyiwa’s murder case, on Tuesday, November 11, at the Boksburg Magistrate Court.Ncube declined to comment on what the discrepancies were.
State prosecutor Gertrude Market told the court that there are new developments in Meyiwa’s murder case.
It’s understood the accused was pointed out by two witnesses to the murder, but inconsistencies have since emerged.
Speaking to journalists outside the court, Ncube said there were questions that arose surrounding the identity parade evidence.
“We cannot keep the accused in custody when all these questions exist,” said Ncube.
The NPA admitted that there is not enough evidence to go to trial, which prompted Magistrate Daniel Thulare to strike the case off the roll, and ordered the immediate release of Mbatha.
He stated that investigators are following up on the new information.
Supporters of slain Bafana Bafana and Orlando Pirates captain and goalkeeper, Meyiwa, expressed their their dispair and anger at the news that there was a lack of evidence against Mbatha to prosecute.
Meyiwa was killed in Vosloorus, Ekurhuleni, while visiting his singer and actress girlfriend Kelly Khumalo last month.Two men allegedly entered the house on October 26 around 8pm, and demanded cellphones before shooting Meyiwa and running away. – @FanieBoksburg
